Execution Application called in continuation of earlier order passed by this court on 12.03.2026. The learned counsels for decree holders and learned counsel for Judgment debtor No. 1, 2 and 3 are present and received the report which has been submitted by Honourable Official Assignee and have heard the learned counsel for decree holders and learned counsel for judgment debtor No. 3 wherein J.D No. 3 has submitted in open court that he has no objection, if the property in question be put in re-auction and he has no objection if the property in question be partitioned among the legal heirs as per law & shariah. Further record reflects judgment has been passed and execution application allowed already. Therefore, the Honourable Official Assignee is hereby humbly requested to execute this judgment dated: 21.06.2021 and decree dated: 26.06.2021 in later and spirit and put the property in question as per reference of the Official Assignee same is attached with ready reference and attach the property in question under the law for publication of re-auction. All the legal heirs of deceased shall bear the expense of public re-auction. Further learned counsel for decree holder present in person and submitted that decree holder and his children are seeking their share in the suit property in respect of share of their deceased mother named Zubaida Idrees including her husband also claiming his share in the share of his deceased wife and showed his pressing need to execute this decree as he is 90 years old and learned counsel for decree holders submitted an application U/s 151 of CPC R/w Order 21 rule 64 and 66 of the CPC with prayer to attach the suit property with extra land in terms of said judgment & decree, so that decree can be executed. The decree holder and his counsel further submitted that J.D No. 3 / Tariq Rasheed is enjoying his possession and have deprived all the legal heirs collect their respective share in subject inherited property and J.D No. 3 is reluctant to sell the suit property and he is habitual to create hindrances to effect the bid in completion of public auction proceeding. Today none of the J.Ds present nor they have filed their objection on this application. Therefore, after hearing of learned counsel for decree holder while J.Ds called absent. In present circumstances, prior to proceed further and order pass on application U/s 151 of CPC R/w Order 21 rule 64 and 66 of the CPC filed by learned counsel for decree holder the Honourable Official Assignee of Honourable High Court of Sindh is hereby directed to issue warning to J.Ds specially J.D No. 3 to lease the share of decree holder in the suit property, in either case property shall be attach through police aid without any issuance of legal notice.
