08.6.2026. Disposed Execution Application No.07/2025 (allowed on 04.6.25) is called for satisfaction of decree dated 03.3.25 passed in Summary Suit No.19/2025. The Decree holder and Judgment Debtor are present. The Judgment Debtor did not file reply to Show Cause Notice issued against him and only submitted that due to domestic issues he did not pay due installment of Rs:80,000 and few months' more time may be granted to him, to which The Decree Holder opposed and submitted that since beginning Judgment Debtor does not deposit installments regularly and for last two months he neither appeared in this court nor deposited installments, so strict legal action may kindly be taken against him. The Judgment Debtor in open court in presence of Decree Holder sought at first and subsequent calls sought time to pay last two installments of Rs: 80,000 till 12-00 noon today but he did not pay the same despite several calls and finally refused. Heard and file perused. Per file in hand the summary suit was decreed vide Judgment and Decree dated;03.3.2025 and Execution Application was allowed on 04.6.2025 and learned I/C Presiding Judge of this court (Mr Zakaullah Abro) declined the prayer of the Judgment Debtor for payment in installments and issued warrants with direction to the Bailiff to arrest the Judgment Debtor for committing him to civil prison unless the decretal amount is deposited in the meantime, vide an Order dated 11-9-2025. However, another I/C Presiding Judge of this court (Mr Nizakat Ali Tanwari) allowed the Judgment Debtor to deposit Rs.40,000 per month on or before 05th of every month till final satisfaction of decree. The Judgment Debtor neither submitted the reply nor deposited two last installments of Rs:80,000/, and also refused to pay the same for few months hence he is hereby ordered to be taken into custody and remanded to civil prison for a period of one year or till payment or furnishing surety too the extent of outstanding decreetal amount. Matter is adjourned to 15.4.2026. LATE AND FURTHER CASE DIARY (01-00 pm). Mr Ali Bux Mahar, advocated appeared and submitted that this court has illegally passed an Order for custody and remand of Judgment Debtor to Civil Prison for non payment of installments, so same order may be recalled and presented an application purportedly signed by the judgment Debtor seeking time. This court therefore informed him that J.D has already been taken into custody and remanded to prison as per law and matter has already been adjourned to 15.6.2026 after hearing the Decree Holder and Judgment debtor in open court. Thereafter, this application, stands filed being not maintianble. This court also informed Mr. Ali BuxMahar that this matter has already been proceeded adn adjourned and Decree Holder also went away to which he become annoyed and went away after issuing threats to file complaint against Reader and Presiding Officer of this court. Per file in hand the learned counsel Mr. Mahar for the first time in last 05 months appeared in this matter at 1;00 pm and exposed him as a counsel for J.D in decided matter. 08.6.2026 (2.30 p.m) This Court's Clerk Mr Shafi Muhammad Ghoto appeared and handed over a copy of an envelope tilted as confidential, so I opened it and found an Order passed by worthy I/C District & Sessions Judge requiring reasons for passing Order against Judgment Debtor on the basis of false complaint filed by Mr Ali Bux Mahar. |
