Cr. Complaint called. All accused are present. Complainant called absent. The accused namely Muhammad Idrees is aged about 90 years old appeared before this court. The accused namely Ameeran Jurio alias Amir Bux aged about 85 years old. The charge is framed today in the court in presence of the counsel and recorded the pleas of all accused persons to which they pleaded not guilty and claiming for trial. As per record both counsel of complainant and accused party given their consent to frame the charge and to initiate the trial under Illegal Dispossession. The complainant did not recorded his statement and both parties were attending the court since 2021. When this court perused that the charge was not properly signed and framed the parties given their consent to frame the charge properly as to initiate the trial. Today charge framed let the mater be fixed for evidence. The complainant strictly required to record his statement on next date of hearing. Complaint called. All accused are present except three accused namely Mian Ameeran Jurio, Mian Anees and Mian Parvez. Their condonation applications are filed by counsels. Condoned as a last chance. Record suggests that present complaint was filed on 21.01.2017 and after registering the same the charge was framed against eighteen accused on 03.08.2021, thereafter complainant has been died and his son namely Aziz Ahmed was allowed on his application to pursue the present complaint during the trial. Such permission was accorded to the son of complainant on 29.03.2022, thereafter not a single witness is recorded and examined till today for about last five years. This complaint is unnecessarily being kept on adjourned due to production of record of Executing Court i.e. court of 1st Senior Civil Judge, Khairpur, which is also available in the shape of R&Ps of executing court. There is no reason and ground for adjournment which are sought by the complainant on each and every date. In these circumstances and in presence of counsel for complainant, the complainant party and their witnesses are hereby granted last and final opportunity to proceed with the complaint, otherwise the matter will be proceeded in their absence as per law.
