Record suggests that present complaint was filed on 21.01.2017 and after registering the same the charge was framed against eighteen accused on 03.08.2021, thereafter complainant has been died and his son namely Aziz Ahmed was allowed on his application to pursue the present complaint during the trial. Such permission was accorded to the son of complainant on 29.03.2022, thereafter not a single witness is recorded and examined till today for about last five years. This complaint is unnecessarily being kept on adjourned due to production of record of Executing Court i.e. court of 1st Senior Civil Judge, Khairpur, which is also available in the shape of R&Ps of executing court. There is no reason and ground for adjournment which are sought by the complainant on each and every date. In these circumstances and in presence of counsel for complainant, the complainant party and their witnesses are hereby granted last and final opportunity to proceed with the complaint, otherwise the matter will be proceeded in their absence as per law.
