Case called. The matter was fixed for framing of charge. The learned ADPP is present. The learned counsel for the accused is present. The accused Ali Nazar Otho is present on bail. However, it transpires from the contents of the FIR that, besides the present accused, the complainant also nominated one Allah Rakhio alias Rakhio son of Manthar Rahu as an accused. However, he has not been sent up by the I.O./SHO for trial. Moreover, there is nothing on record to show whether he was discharged, released, found innocent during the investigation, or acquitted by any competent forum. This fact reflects that his name was omitted by the I.O. for reasons best known to him; however, such omission does not amount to his acquittal. Accordingly, in order to determine the fate of the allegations levelled against him in the FIR, the I.O./SHO, Police Station Daulatpur, is directed to submit a supplementary challan regarding the said accused. The office of this Court is also directed to call for the supplementary challan accordingly. In view of the above circumstances, the matter is adjourned to 01.08.2026 for submission of the subsequent report/supplementary challan. The present accused is directed to attend the court. |
