Matter called. The Advocate for Plaintiff alongwith Plaintiff of leading suit are present. None is present on behalf of Defendant No.1 of leading suit/Plaintiff of the subsequent suit namely Nadeem Dar. It is noted that Mr. Liaquat Ali Khan, Advocate of Defendant No.1/Nadeem Dar of leading suit has already withdrawn his Vakalatnama on 11.09.2025. Order passed on separate order sheet. In view of the above circumstances and to meet the ends of justice, the inadvertent procedural irregularity is hereby rectified. The proceedings are restored to their actual legal position as existed prior to 13.05.2025. Both suits viz. Civil Suit No.2217/2024 and Civil Suit No.70/2025 shall be proceeded separately until required consolidation in future. The Vakalatnama filed by Advocate for Defendant No.2 of leading suit in Civil Suit No.2217/2024 is accepted and taken on record. Office to provide copies of the plaint and other relevant documents to Advocate for Defendant No.2 of leading suit for filing of written statement till next date of hearing. Issue of service upon Defendant No.3 to be reissued accordingly where same was left. The Advocate for Plaintiff of leading suit to submit counter affidavit on application under Order VII rule 11 CPC. The case diary in Civil Suit No.2217/2024 and Civil Suit No.70/2025 shall be prepared accordingly. Put off to 18.11.2025 for supply of copies of plaint and its annexure to Defendant No.2 of leading suit for filing of written statement, counter affidavit on application under Order VII rule 11 CPC by Plaintiff of leading suit and service upon Defendant No.3 of leading suit through Bailiff. |
