23-09-2026. Matter called. Learned counsel for the defendant No.01 (a to g) appeared and filed application U/s 151 CPC R/w section 73, 116 and 117 of the Sindh Cooperatives Societies Act 2020 and rule 53 of the Sindh Cooperative Society Rules 2020 with prayer to refer the matter to the Honourable District Judge, Mirpurkhas by arguing that the matter pertains to Society Court. 15-09-2026. Matter called. Plaintiff appeared in the morning and went away without waiting call of the court or requesting either to adjourn or to keep aside during course of the day. Learned counsel for plaintiff called absent. Mr. Taimoor Qureshi, Advocate appeared in the morning, marked attendance and went away without filing his vakalatnama on behalf of L.Rs of defendant No.01 (a to i) as was assured by him on preceding date, reflecting the same in order sheet dated: 03-09-2026. The matter is fixed for evidence of plaintiff side and filing of objection on application U/o 32 rule 03 CPC by defendant side. Per record issues were framed on 24-01-2023, evidence (examination in chief) of official witness Tapedar recorded at Exh-41/- on dated: 30-07-2024, his cross-examination was reserved at the hands of defendants No.01 and 02 due to their absence while defendants No.03 to 08 are being proceed exparte. His cross-examination by defendant No.01 was conducted on 05-11-2024 while his cross was declared as Nil on part of defendant No.02 vide dated: 05-11-2024. The examination in chief of plaintiff Adnan Muhammad was recorded on 23-10-2024, his cross-examination was reserved on part of defendant No.01 as learned counsel for defendant No.01 filed application for adjournment while his cross-examination was reserved on part of defendant No.02 due to absence of defendant No.02 side. Since then the cross-examination of plaintiff has not been recorded due to part of either side. On previous date clear directions were given to the parties to proceed with the matter, failing which any appropriate order shall be passed.. Despite of that neither the plaintiff side nor defendant No.02 have bothered to proceed with the matter as their conduct has been reflected herein above which cannot be tolerated further and inviting the court conscious for passing adverse orders. Nevertheless, this court is once again observing restraint. Virtue of aforesaid position, defendant side is hereby debarred from filing objection on application U/o 32 rule 03 CPC. Let said application be fixed for order with liberty to both sides for meanwhile arguments till next date, failing which order shall be announced. As the facts discussed above it reveals that both sides are causing unnecessarily delay in the proceedings of present suit, therefore, cost amount of Rs.2,000/- is hereby imposed upon plaintiffs No.01 to 04 to be paid / deposited by them till next date in district court dispensary on proper receipt, failing which any appropriate order shall be passed. Similarly cost amount of Rs. 2,000/- on defendants No.01 and 02 separately, the defendants No.01 and 02 shall deposit the cost amount of Rs.2,000/- each in district court dispensary till next date, failing which any appropriate order shall be passed. Matter adjourned to------------23-09-2026 for cross-examination of plaintiff by defendants No.01 and 02 as well as order on application U/o 32 rule 03 CPC with liberty to both sides meanwhile arguments, failing which order shall be announced on it, filing of Vakalatnama on behalf of defendants No.01 (a to i) by Mr. Taimoor Qureshi as was under took by him on previous date. It is clarified that in case of failure of either side adverse order shall be passed against defaulting party.
