Case called. accused is present on bail. ADPP and DA present. accused filed application under section:249-A crpc.order on it. Heard.order passed and announced in open court. That Honourable High Court of Sindh in case reported as 2017 PCRLJ 219 (Sukkur bench) has observed that recording of prosecution evidence is not mandatopry condition while passing the acquittal order under section:249-A crpc and in absence of tangiable evidence further trial would be futile exercise. Hence, I am of the humble view that there is no probability of the applicant/accused being convicted of any offence, therefore applicant/accused is hereby acquitted under section 249-A, Cr.P.C. Accused ispresent on bail his bail bond stands cancelled and surety discharged.
