In view of the order dated 10.07.2025 passed in C.P No.D-625 of 2025,Re: Hafeezullah Lashari Vs. The state, by the Honourable High Court of Sindh, Circuit court, Larkana wherein it has been held that in terms of the statutory provisions of chapter I, Section 2, sub-section (pp) & (qq),of Sindh control of Narcotics substances Act 2024, unless and until the provincial Government formally designates or notifies a Court or Tribunal, the Courts established under section 30 Cr.P.C, or any other court empowered to exercise the powers of a Special court under the Sindh control of Narcotics Substances Act 2024- including the Courts of the Sessions Judge- are legally authorized and competent to hear and adjudicate matters falling within the ambit of the said Act, therefore in compliance of the above-quoted order and seeking guidelines from the same, let matter be proceeded till receipt of further directions. Today case is fixed for charge. Charge framed upon accused at Ex. 02. Plea recorded to which accused pleaded not guilty and claimed trial. The State, by the Honourable High Court of Sindh Karachi, communicated through the office of worthy Registrar, Honourable High court of Sindh Karachi, vide his good office letter No.GAZ/Circulation of judgment/SHC, dated 21.5.2025, whereby all the courts in Sindh province, including Special Courts previously constituted under the CNS Act, 1997 are restrained from assuming jurisdiction in relations to offences committed after the enforcement of Sindh Control Substances Act 2024, where proceedings have been initiated under the repealed law of control of Narcotics Substances Act 1997, therefore in compliance the above quoted order and seeking guidelines from the same, the matter stands adjourned till receipt of further directions.
