The suit is called. The plaintiff, Muhammad Ishaque Brohi, is present along with his learned counsel, Mr. Muhammad Ibrahim Lashari, Advocate. Learned DDA appears on behalf of the official defendants No.01 to 04. A careful perusal of the record reveals that the plaint was previously returned to the plaintiff under Order VII Rule 10 C.P.C. on the ground of lack of jurisdiction, vide order dated 08.09.2025 passed by this Court. Subsequently, the plaintiff assailed the said order by preferring Civil Revision Application No.35/2025 before the Honourable District Judge, Jacobabad. It further transpires that, vide order dated 28.10.2025, rendered in Civil Revision No.35/2025 titled Muhammad Ishaque Brohi Vs. P.O. Sindh & others, the Honourable District Judge, Jacobabad was pleased to allow the revision application and set aside the impugned order dated 08.09.2025 passed by this Court. In consequence thereof, the instant suit stands restored to its original number and position. Office is hereby directed to issue Court Motion Notices to all defendants, except those who have already been debarred from filing written statement as well as those whose defense has been struck off. The matter put off to 17.03.2026 for framing of issues. |
