Today, the case was called repeatedly at 09:00 a.m, 10:30 a.m., 11:30 a.m., and 12:00 noon. The prosecution namely SIP Muhammad Ramzan, SIP Paharddin Dahani, Mallkhana Incharge Waseem Akram Lashari witnesses are present. The accused namely Noman, Muhammad Haroon, Muhammad Asif, Muhammad Mustaqeem @ Salqleain, Kamran, Muhammad Imran, and Sanaullah Khan appeared before the Court on bail. Accused Muhammad Saleem Akhtar and Wajid Ali Shah were absent. Accused Rizwan Ahmed has already been declared a proclaimed offender vide order dated 24-08-2024. The personal appearance of accused Muhammad Saleem Akhtar and Wajid Ali Shah had earlier been dispensed with through orders dated 18-03-2025 and 12-11-2024, subject to furnishing solvent surety in the sum of Rs.100,000/- and on the condition that their counsel would appear on each date of hearing. The case had been scheduled/ fixed for recording of evidence from 27-04-2026 to 29-04-2026. Yesterday, the further examination-in-chief of the complainant was recorded at Exh:08, while cross-examination was reserved due to the absence of learned defence counsel Mr.Hussain Bux. Today, despite repeated calls, the counsel for accused Muhammad Saleem Akhtar and Wajid Ali Shah did not appear. Due to their absence, further proceedings could not continue. This conduct is in violation of the condition attached to the exemption granted under Section 205 Cr.P.C., which required their counsel to attend regularly. The record shows that charge was framed on 04-10-2024, and the case has remained pending for a considerable period. The prosecution evidence has not yet been concluded due to repeated delays caused by absence of accused persons, their counsel, and prosecution witnesses. It is further noted that the associates of the absent counsel were present on yesterday and are fully aware of today???s hearing, yet no appearance was made without any justification. The learned ADPP for the state pressed the application for recalling the orders passed by this court u/s 205 Cr.PC filed on 16-02-2026 and argued that the order dated:18-03-2025 and 12-11-2024 passed u/s 205 Cr.PC may kindly be recalled as accused are misusing the authority and they are not complying with these order. In these circumstances, the application earlier filed by learned ADPP for recalling the orders passed under Section 205 Cr.P.C. is considered justified. The accused have misused the concession granted to them and failed to comply with the conditions imposed by the Court. Accordingly, the application is allowed. The orders dated 18-03-2025 and 12-11-2024 are hereby recalled. Accused Muhammad Saleem Akhtar and Wajid Ali Shah are directed to appear before the Court in person. The office is directed to issue notices to them through the SHO of the concerned police station. The witnesses present are bound down to appear on the next date of hearing.
