Rent case called. Learned counsel for applicant is present. No one is present from the side of opponent, as the learned counsel for the opponent appeared in the morning session and matter was kept aside at 11:30 a.m. but none is present right now from the side of opponent. The learned counsel for applicant filed a statement whereby he complaint above errors in writing the earlier diaries in the case as after order dated 05.11.2025 the matter should have been fixed for evidence of the opponents but as per diary the matter is being constantly fixed for cross of applicant and prayed for correction of the Court diaries. Record perused that and same reflects that vide order dated 05.11.2025, on the application of opponent, the side of opponent was recalled by setting aside earlier order dated 15.09.2025 with the condition to pay cost of Rs.3000/- and then the opponent was directed to lead evidence on the upcoming date. In the same order it is clearly mentioned that in case of failure to lead evidence by the opponent that order shall stand vacated automatically. But despite of that the reader has wrongfully written the diary which is not bearable late the explanation be called from the reader. In the interest of justice an opportunity is provided to the opponent to appear on the next date and clarify the position for non-compliance of order dated 05.11.2025. Put on dated 26.03.2026, for opponent evidence. |
