The instant application has been filed on the two grounds i.e. they have not received the certified copy of the deposition of the plaintiff same is hereby provided in open Court to her from CFMS generated copy free of cost and another ground she took that she is not feeling well. Without touching the medical report submitted by the learned counsel for the defendant of her. order passed on it. The applicaiton is allowed with last and final chance meanwhile in open Court the learned counsel for the defendant herself mentioned in the adjournment applicaiton that next date of her final arguments in instant suit of 19-09-2025 at 11:00 a.m. such choice of next date for the final arguments is hereby provided to the learned counsel for the defendant in the interest of justice. The learned counsel for the plaintiff is also in attendance. Suit called. The learned counsel for the plaintiff and the plaintiff are present and ready for the cross examination of the plaintiff. The learned junior counsel for the defendant is present at first call and stated that the case may be fixed at 12:00 p.m. as the senior counsel herself proceed with the matter. Subsequently the case was again called at 12:00 p.m. the junior counsel for the defendant appeared and stated that the senior counsel is not coming for the proceeding of the case and she is busy before the Honorable High Court of Sindh, Karachi and the case may be adjourned without filing of any written application. This Court has observed that the both suits are one of the oldest case and due to non-seriousness of the defendant the case is being adjourned without any reasonable cause same are increasing in the backlogs of the cases. The parties are suffering agony of trial which is also violation of fair trial under Article 10-A of the Constitution of Pakistan. The defendand and his counsel are hereby directed to must be present before this Court for the cross examination of the plaintiff on 08-09-2025 at 01:00 p.m. wherever anyhow must be present before this Court for the proceeding of the case as per law. In case of failure to proceed with the case the right of the cross examination of the defendant side will be struck off under order XVII Rule III of CPC. Matter is now fixed on 08-09-2025 at 01:00 p.m. for Cross Examination of the plaintiff side as last and final chance. |
