Today work is suspended due to strike to TBA Pano Aqil. Case called. Accused (1) Abdul Rasheed, (2) Abdul Rehman and (3) Abdul Kareem are present on bail, while accused (4) Alltaf and (5) Alifuddin are declared as proclaimed offenders. ADPP for the state and counsel for accused are present. BWs against I.O/SIP Peer Bux was issued same returned duly served and summons to complainant and rest witnesses, Complainant ASI Azhar Ali and I.O/SIP Peer Bux are present and bound down. Malkhana Incharge/WHC is called absent on his behalf of letter received from SHO PS Pano Aqil. Order on it. Malkhana Incharge failed to appear in person to submit reply hence he may be called in person and be heard on next date without fail. SHO of police station Pano Aqil is present and filed his reply of show cause notice. Order on it. The reply of show cause is kept on record and in subject to compliance, therefore, the fact shall be deceided. Case property has been produced by SHO of concerned PS, same returned to concerned PS with directions to produce again on given date. ADPP for the State is present. Amended charge framed at Ex. No. 08. Plea of accused is recorded at Ex.8-A in which he is pleaded not guilty and claimed for trial. Summon to complainant and PW Mahir Yasir Ali was issued same returned duly served upon them, they are in attendance and bound down. PW PC Sohail Ahmed and I.O/SIP Peer Bux were bounded down on last date of hearing but today they are called absent without any intimation. Perusal of record further reveals that the SHO/Malkhana In-charge has failed to produce the case property involved in the present crime as mentioned in column No.05 of the challan, despite strict directions of this Court. Learned ADPP for the State has also submitted that despite special messenger/court moharrir, the police officials of P.S. Pano Akil have failed to comply with the directions of this Court, which is causing unnecessary delay in the proceedings of this case. It is also noted that the SHO and WHC were contacted repeatedly in the morning and the matter was kept aside for want of case property; however, till 12:30 p.m., the police of P.S. Pano Akil have failed to produce the same. Such conduct, behaviour and negligence on the part of the SHO/Malkhana in-charge prima facie shows intentional and willful disobedience of the lawful directions of this Court for the reasons best known to them. Therefore, show cause notice is issued to the SHO, P.S. Pano Akil and the concerned Malkhana In-charge under section 174 Cr.P.C, section 175 C.P.C and other relevant provisions of law, calling upon them to explain as to why appropriate legal action should not be taken against them. Moreover complainant ASI Azhar Ali and mashir PC Yasir are present. Whereas PW PC Sohail Ahmed and I.O./SIP Peer Bux, who were already bound down on the last date of hearing, have failed to appear for recording of prosecution evidence, which also amounts to willful disregard of the orders of this Court. Office is directed to issue bailable warrants against PW PC Sohail Ahmed and I.O./SIP Peer Bux. Further, the PR bond in the sum of Rs.10,000/- taken from them on the last date of hearing shall be sent to SSP Sukkur for deduction of the said amount from their salaries and deposit of the same in Government treasury under proper head, under intimation to this Court. Put off to 19-02-2026 for evidence. The concerned officials are directed to submit reply to the show cause notice and SSP Sukkur report regarding deduction of salary on the next date of hearing. Office is further directed to issue summons to the remaining witnesses and again call for the case property. Present accused are directed to attend the Court on the next date of hearing.??? |
