Accused Inayat S/o Kando is found guilty of offence which is punishable U/S 147 R/w section 149 PPC therefore, he is convicted and sentenced as below. He is directed to pay the fine of Rs.500/- for the offence and sentenced till rising of the court for the offence which is punishable under section 147 PPC. In case, if he failed to pay the fine amount, then he shall undergo for 05 days in simple imprisonment. Accused Inayat S/o Kando is further found guilty of an offence which is punishable U/S 337-F(i) PPC R/w section 149 PPC therefore, he is convicted and sentenced as below. He is directed to pay Daman amount of Rs.10,000/- (ten thousand rupees only). Accused Inayat S/o Kando is further found guilty of an offence which is punishable U/S 337-A(ii) P.P.C R/w section 149 P.P.C therefore, he is convicted and sentenced as below. He is directed to pay Arsh amount of Rs.337,895/- (three lac, thirty three thousand, eight hundred & ninety five rupees only) being five percent of Diyat (Total amount Rs.6,757,902/- which was declared by Government of Pakistan vide Notification of dated 04-09-2023 for the year 2023-2024). The amount of Arsh viz; Rs.337,895/- shall be paid by accused Inayat to the injured Sain Dino in installments of Rs.40,000/- within 08 months and the remaining amount of Rs.17895/- shall be paid in additional period of 01 month. Accused Inayat S/o Kando is found guilty of an offence which is punishable U/S 337-L(ii) P.P.C read with section 149 P.P.C therefore; he is convicted and sentenced as below. He is directed to pay Daman amount of Rs.10,000/- (ten thousand rupees only) to the injured Sain Dino. The amount of Daman shall be deposited by him in this Court for its onward payment to the injured, and in case of default he shall be kept in jail to suffer simple imprisonment till its payment, however, he shall be released on bail if he furnishes the security in the sum of Rs.10,000/- for the satisfaction of this Court. Accused persons namely Mazhar alias Mazar S/o Tagio Rodnani, Wahid Bux S/o Tagio Rodnani and Niaz alias Niazoo S/o Kando Rodnani are hereby acquitted U/s 245(1) Cr.P.C of the charge of the offences which are punishable U/s 147, 149, 504, 337-A(ii), 337-F(i), 337-L(ii) U/s 245(1) Cr.P.C. Accused Inayat S/o Kando is acquitted U/S 245(1) Cr.P.C of the charge for the offence which is punishable 504 PPC, however the accused Inayat S/o Kando was taken into custody and sent to the Central Prison Jail Hyderabad through Superintendent Judicial Lock Up Sehwan for serving the sentence as awarded to him, and will remain therein until full payment of Daman and Arsh, however, the accused shall be released on bail if he furnishes the security in the sum of equal to value of Daman and Arsh which stated above in paragraph No.25 of the judgment and but he fails to pay the said amount of Daman and Arsh then he will be dealt in same manner as if sentenced to simple imprisonment. While absconding accused persons namely Liaquat S/o Wahid Bux, Altaf S/o Kando Rodnani and Saddam S/o Kando Rodnani be kept on dormant file until their arrest or otherwise their appearance before this Court. In compliance of section 371 Cr:P.C a copy of the Judgment shall be supplied to the accused persons without cost.
