Mr. Pirkash Lal advocate has filed an application u/s 265-K Cr.PC on behalf of accused Farooque and Ghulam Hussain. Order. Notice to DDPP for the state, notice waived by DDPP and same application brought on record at Ex.9. Arguments heard from both sides. Order passed and announced in open Court at Ex.10 that accused Farooque s/o Wahid Bux Mazari and Ghulam Hussain son of Qadir Bux Mazari are acquitted u/s 265-K Cr.Pc. The accused Ghulam Hussain is present on bail, his bail bonds stand cancelled and surety is discharged. Accused Farooq is produced in custody through video link, such acquittal intimation be issued immediately with direction to jail authorities to release the accused from the custody forthwith in this case only and if he is not required in any other case. Case against absconding accused be kept on dormant file, till their arrest or surrender before the court. |
