Case called. The plaintiff No.1 in person along with associate of his counsel is present and moved an application for extension of status quo. Learned District Attorney representing defendants No.1 to 3 is present and filed written statement on their behalf. Learned counsel for the intervenor is present and filed an application under Order I, rule 10 CPC. Learned counsel for the intervenor contends that the jurisdiction of this Court is barred by law and that learned counsel for the plaintiffs obtained an order of status quo by misrepresenting the facts before the Court. The Executive Engineer, Irrigation Department, defendant No.1, is also present. The learned District Attorney also contends that the plaintiffs ought to have raised their grievance before the relevant competent authorities instead of approaching this Court without clean hands and obtaining an order of status quo. He further argues that the suit is not maintainable before this Court.. Plaintiff No.1 is present in person. Upon being asked about the situation, he submits that the Irrigation Department itself had previously constructed the watercourse and is now, under the influence of influential landowners, altering the existing arrangement, which would cause irreparable loss to the plaintiffs, who are also landowners situated at the tail end of the watercourse. He further submits that his counsel is out of station and requests an adjournment to enable his counsel to appear and advance arguments on his behalf. Heard the learned District Attorney, defendant No.1 in person, learned counsel for the intervenor, and plaintiff No.1 in person, and have perused the record and relevant law. Order passed on order sheet, The ad-interim injunction order dated 15.07.2026 passed by this Court has been recalled. The plaintiff is put on notice to satisfy this Court regarding the maintainability of the suit in view of the provisions of law. The matter is adjourned to 27.10.2026 for hearing on the maintainability of the suit. |
