15-09-2026. Matter called. Matter has recently been transferred from the Court of the learned Senior Civil Judge-III, Mirpurkhas, on administrative grounds pursuant to the order passed by the learned District & Sessions Judge, Mirpurkhas, for its expeditious and meritorious disposal in accordance with law. Today, the matter is fixed for plaintiff???s evidence. Matter was called in the morning, but none appeared on behalf of either side; therefore, the matter was kept aside. Thereafter, learned counsel for defendants No.01 and 02 appeared and filed application for adjournment at Ex:74 stating therein that compromise talks are going on between the parties. After that, learned counsel for the plaintiff appeared along with the plaintiff. As per the diaries, issues were framed on 17-08-2022, and the evidence of plaintiff No.05, who appeared as his own witness as well as attorney for the remaining plaintiffs, was recorded on 03-12-2025 and 13-01-2026. However, his cross-examination could not be conducted due to the absence of learned counsel for defendants No.01 and 02. Since then, the matter has repeatedly been adjourned from date to date for want of cross-examination of the said plaintiff. Virtue of the aforesaid position, matter adjourned in the interest of justice, with direction to both sides to proceed with the matter on the next date, failing which any appropriate order shall be passed. Matter is adjourned to--------------23-09-2026 for plaintiff???s evidence. |
