Today, the matter is fixed for filing of written statements on behalf of defendant No.1 Ayaz s/o Sodho and other defendants. Perusal of the record reveals that defendant No.1 is the only private defendant, whereas the remaining defendants are official functionaries. Learned counsel for the plaintiff, Mr. Muhammad Yousif Magsi, requested that the matter be proceeded ex-parte against the defendants. However, the record reflects that although defendant No.1 has been served through Bailiff, no further efforts have been made to secure his attendance through substituted modes of service, namely door pasting or publication in a newspaper. It is a settled principle of law that no person should be condemned unheard, and reasonable efforts must be made to ensure proper service before proceeding ex-parte. In the interest of justice, let fresh notice be issued to defendant No.1 through publication in the daily newspaper ???Daily Phanji Akhbar??? as well as through door pasting at his given address, at the cost of the plaintiff.
