Case called, Accused Fawad Qureshi is present on bail on first call and on second call he remained absent. Learned ADPP for the state and learned counsel for the complainant are present. The learned counsel for the complainant stated that this Court is favoring extra ordinary to the accused party and the complainant party having no faith upon this Court. Further, the learned counsel for the complainant party has also filed the adjournment application mentioning the grounds thereon that the accused party is using the delay tactics and learned counsel for the accused has obtained the adjournment in the transfer application on personal grounds. Order passed thereon. Application dismissed and order passed as cae diary. It is important to mention here on the previous date i.e. 16-03-2026 the learned counsel for the complainant has also filed the application for the adjournment mentioning the ground thereon that the transfer application is pending before the Honorable Court of sessions. The instant application was allowed with last and final chance with direction to proceed with the matter on next date of hearing but today the complainant party neither producing the witnesses just wants the adjournment on flimsy ground and failed to provide any copy of the stay order. It is settled principle of law that mere pendency of such a transfer petition, in the absence of the stay order, could not stop a court from proceeding with the case (2021 MLD 1864 ISLAMABAD). Without proceeding of the case the case cannot be adjourned on the flimsy grounds. Keeping in view of the facts and circumstances of the case without proceeding / recording of the evidence of official PWs this Court having no other option. Hence, let the matter be further proceeded as per law. Issue process against the all official PWs and the matter will be proceeded on day by day basis. Matter is now fixed on 08-04-2026 for Evidence. |

Order received from the honorable Court of sessions passed in Criminal Revision application no. 27 of 2026 on 12-02-2026. I would like to reproduce here the observation / stay order passed by the Honorable Court of Session for not to record evidence of any witness till the disposal of said revision application in Para no. 03 further proceedings in the said case before learned trial Court are hereby suspended till the disposal of this criminal revision application. The learned trial Court is directed not to record the evidence of any witness till the disposal of this revision application and Call R&Ps. The learned counsel for the accused has filed the application u/s 205 Cr.P.C. for the exemption of the applicant / accused from his personal appearance and allowed him to be represented by his advocate until the pendency of above mentioned stay order or disposal of criminal revision application no. 27 of 2026. Order passed on it. The application is hereby allowed till further order and no purpose will be serve out in the calling of accused, neither any application is pending except the applications filed by the accused and the evidence of the PWs is also could not be recorded due to the legal restriction has been imposed by the Honorable Court of Sessions in criminal revision application no. 27 of 2026 vide order dated: 12-02-2026. Case called, Accused is present on bail along with his counsel. Learned ADPP for the state and learned counsel for the complainant are present and has filed the application u/s 227 Cr.P.C. for amendment of charge, order passed on separate sheet. The instant application is hereby dismissed having no merits. Process server appeared and submitted the process report same is kept on record. The perusal of the process report shows that complainant is out of Karachi, while the ASI Babar and P.I Muhammad Tariq are not feeling well. On the other hand the complainant party is not producing their all private PWs despite of given direction on last date of hearing. This Court has observed that the complainant party is not willing to produce their witnesses just to prolong the proceedings of the case. The complainant party is intentionally / deliberately not producing their all PWs before this court for recording of their evidence. It is important to mention here that on the previous date i.e. 23-12-2025 the complainant party has already filed the similar application for the adjournment of the case on the same ground. On one hand the complainant party is claiming for the justice on the ground of victim but intentionally / deliberately not producing their witnesses just to prolong the case by using delay tactics. The learned counsel for the accused has filed the statement that he will proceed / argue the application u/s 249-A Cr.P.C. after recording of the evidence of the private PWs same statement is also kept on record. Keeping in view of the current situation of the case and in order to avoid from the further delay the complainant is called hereby in person along with her all PWs through I.O. of the case. The SHO of P.S. Darakhshan is also hereby directed to produce the PWs wherever they are must be in attendance before this Court on next date of hearing without fail. Further, the case will be proceeded on day by day basis. Matter is now fixed on 16-02-2026 for Evidence. Issue process against the all PWs through the SHO of P.S. Dararkhshan. Accused is directed to attend. |
