Suit called. Learned counsel for plaintiff is present. Matter is fixed for service upon defendants. Summons returned. The statement of bailiff is recorded record at Ex------------- 06 wherein he produced report at Ex---------- 06/A stating therein that in compliance of Court orders he visited the given address of the defendant No. 04 where he came to know that defendant No. 04 had shifted to Hyderabad long ago therefore the service could not be made. He also visited the offices of defendants Nos. 02 & 03 and got received the notices to their respective clerks and obtained such receiving/signature as well as official stamp affixed on it. Order passed on separate sheet at Ex-----------07. In compliance with the notice served, Defendant No. 02 (Sub Registrar Hala) got submitted his written statement through authorized official namely Mr. Israr Ahmed Leghari, Daftari which is kept on record at Ex----------- 08. The Defendant No. 03 (Mukhtiarkar Reveneu Taluka Hala) got submitted his written statement through authorized official namely Mr. Ayaz Ali, Senior Clerk which is kept on record at Ex------------- 09. The learned DDA for official defendants made her appearance and filed memo of appearance on behalf of official defendants Nos. 01 to 03 which is kept on record at Ex----------- 10. Learned DDA also filed statement whereby she adopted the written statement filed by the defendant No. 03 on behalf of defendant No. 01. Such statement is kept on record at Ex -----------11. In view of the above service upon the defendants Nos. 01 to 03 is declared sufficient and the same is treated as good service for the purpose of further proceedings. As far as the service upon defendant No. 04 is concerned, the plaintiff is directed to provide fresh/new address of defendant No. 04 for service and once the fresh address is provided/brought on record, the plaintiff is required to get issue/repeat the notice upon defendant No. 04 within three days for service upon the defendant No. 04. Such compliance/exercise is ordered to be completed before next date of hearing. Put off to ------------- 22-07-2026 for service upon defendant No. 04. |
