Perusal of record transpires that issues have been framed in this case on 13.10.2022 and since then the matter is fixed for plaintiff???s. Several opportunities were given to the plaintiffs side to lead evidence but failed to adduce evidence. On the last date of hearing, i.e. 21.11.2024 learned counsel for plaintiff filed adjournment application which was allowed as last and final chance subject to cost of Rs.2000/- to be paid to the defendants side by the plaintiff side. Today, again plaintiff side failed to adduce his evidence so also failed to pay fine amount which was imposed upon him on the last date of hearing. From conduct of the plaintiffs side, it appears that the plaintiff is reluctant to proceed with the matter, such attitude of plaintiff shows that he is not interested to proceed with the matter as per law, therefore, due to negligent attitude of plaintiff, instant suit of plaintiffs stands dismissed in default/non-compliance.
