The present summery suit is pending before this trial court since year 2020. The record of the suit suggest that this court passed order on 12.12.2022 thereby rejecting the application of the defendant filed U/O 7 Rule 11 CPC with directions to the defendant to furnish security in the sum of Rs: 3,0000000/- (three crore) but the defendant neither submitted security not challenged the same order at the higher forum. Learned counsel for plaintiff submits statement at bar that the order dated 12.12.2022 passed by this court is still in field.
