Matter called. None is present from either side. Matter is fixed for filing of Affidavit in Evidence by Plaintiff of leading suit. Order passed on separate order sheet. Record shows that the conduct of Plaintiff of leading suit as depicted from record that on 24.12.2024, Issues were settled by this Court and Plaintiff of leading suit was directed to file his affidavit in evidence and lead his evidence. Thereafter, matter was continuously fixed from 24.12.2024 to 19.04.2025, as well as today but Plaintiff of leading suit failed to file his affidavit in evidence and lead his evidence. The conduct of Plaintiff of leading suit seems that he is no more interested to proceed further with the case as inspite of so many chances he has failed to file his affidavit in evidence and lead his evidence. Hence, this Court has no alternate except to close the side of Plaintiff of leading suit for filing of his affidavit in evidence and to lead his evidence though fullest opportunities provided to him.
