Since the offence under section??302 PPC is compoundable as per schedule and in this case the complainant Abdul Razzaque who is son of the deceased, has submitted compromise application stating therein that they have voluntarily made compromise with the present accused and has no objection, if the present is acquitted from the charge, however, he does not waive the right of compensation against the present accused. In these circumstances when the compromise arrived at by the parties appears to be voluntarily in nature, I am of the view that the application under section 345-2 Cr.P.C seeking permission to compound the offence, merits consideration, therefore, the same is hereby allowed and in consequence thereof, the application U/S 345-6 Cr.P.C also stands allowed. Resultantly the accused namely Abdul Qadir son of Jan Muhammad by caste Bahalkani, is hereby acquitted under section 345-6 Cr.P.C. It is admitted fact that the complainant Abdul Razzaque being son of the deceased Abdul Malik alias Fata, has only extended his no object for acquittal of the present accused Abdul Qadir and he has not waived the right of Qisas, diyat, Arsh etc. Apart from this there are 13 other legal heirs of the deceased including minors and 03 widows but complainant has failed to produce them before this court in order to extend their no objection for acquittal of accused or to waive their right of compensation due against the present accused. Therefore, although ??the accused is acquitted under section 345-(6) Cr.P.C in consequence of compounding the offence by the complainant/son of the deceased but the remaining legal heirs have not appeared before this court to waive their right of compensation, therefore, I am of the view that in spite of acquittal under section 345-(6) Cr.P.C the accused namely Abdul Qadir Bahalkani, is required to pay Diyat amount to all the above named legal heirs of the deceased Abdul Malik alias Fanta Jageerani. The Diyat amount shall be paid by the accused with reference to current financial year. In order to execute instant order accused Abdul Qadir, by caste Bahalkani, who is present before court on bail, is taken into custody, and remanded to Central Prison and Correctional Facility Sukkur for want of payment of Diyat amount to the above mentioned legal heirs of the deceased named above, however, he shall be released on bail subject to furnishing solvent surety equal to Diyat amount imposed on him by this court. In case of non payment of above mentioned Diyat amount by the above named accused, to the legal heirs of the deceased named above, the accused shall remained behind the bars until he makes the payment of above mentioned Diyat amount good to the above mentioned legal heirs of the deceased and the same amount shall be recovered from the accused, as arrears of land revenue.
