06-10-2026. Matter called. It is fixed for cross-examination of the plaintiff and further evidence of plaintiff side, hearing on injunction application as last and final chance. None appeared from plaintiff side though matter called repeatedly. On the other hand, Mr. Bhagwan Das, learned counsel for defendants No.01 to 06 is in attendance. The record reveals that this is the matter pertains to the year of 2021 being old in nature. It remained pending before the court of learned Senior Civil Judge-III, Mirpurkhas till September, 2026 for cross-examination of plaintiff side. It is appeared from the record that issues were framed on 02-10-2021 thereafter, examination in chief of plaintiff was recorded on 21-11-2022 and matter was fixed for cross-examination of the plaintiff. But since then neither the plaintiff nor his counsel bothered to appear for getting record their cross-examination despite of the fact that number of chances extended to plaintiff side. The record reveals that the suit of the plaintiff was dismissed in non-prosecution on 24-05-2025 and thereafter it was restored upon own application of plaintiff side vide order dated: 10-07-2025 even then further number of chances extended to plaintiff side for his cross-examination and further evidence if any, but of no avail. Today, same position has been observed as neither the plaintiff nor counsel appeared though the matter called repeatedly till 11:30 A.M. No intimation or adjournment been moved from plaintiff side. Virtue of aforesaid position, it appears that plaintiff side has lost interest in his own cause, hence adjourning the matter on the same piston would serve no purpose rather it would necessary linger on the matter. As such, the examination in chief of plaintiff recorded at Exh-30/- is hereby discarded. The side of the plaintiff evidence is hereby closed though several chances extended but of no avail. 14-09-2026. Matter called. It has been recently transferred from the court of learned Senior Civil Judge-III, Mirpurkhas upon administrative ground / order passed by Honourable District Judge, Mirpurkhas for its expeditious / meritorious disposal in accordance with law. It is fixed for plaintiff side evidence / cross-examination but none appeared from plaintiff side. Per record the issues were framed on 02-10-2021 thereafter examination in chief of plaintiff was recorded on 21-11-2022 and matter was fixed for cross-examination of plaintiff. As many as 23 dates of hearing were passed but plaintiff side failed to appear therefore, the matter was dismissed in non-prosecution vide order dated: 24-05-2025 thereafter it was restored upon application filed by plaintiff vide order dated: 10-07-2025 but even then 15 dates been passed, the plaintiff side again failed to appear for their cross-examination.
