Case called. Accused Aijaz Kalhoro is present on bail, his counsel Mr.Ashiq Ali Kalhoro is present, while accused Naveed is P.O. ADPP for the State is present. Complainant Mst.Shaher Banu is present. Final arguments heard. Judgment passed and announced in open Court. Accused Aijaz Kalhoro is convicted u/s 265-H(ii) Cr.P.C for committing offence punishable under section 354 PPC. He is sentenced to serve 15 days simple imprisonment , a terms he has already having been arrested on 02.6.2023 and released on 19.6.2023 alongwith fine of Rs.30,000/- to be paid to the complainant. In case of failure he shall suffer S.I for 03 months. However rather than immediately taking him into custody upon pronouncing this judgment due to his failure to pay the fine. I opt to postpone the execution of the imprisonment sentence. The decision is based on the imprisonment term being less than one year. He is granted bail under section 382-A Cr.P.C on the same surety as his current bail until the period for filing an appeal against the judgment expires. If an appeal is lodged within that timeframe, bail will continue until the imprisonment sentence is confirmed by the Honourable Appellate Court. The case against accused Naveed is kept on formant file till his arrest/surrender. Judgment placed on record vide Ex------------------19. |
