This sessions case was instituted upon a direct complaint. The complainant, who is himself an advocate, is present along with his one witness Waqas Arain. His learned counsel is absent. All accused are present on bail, accompanied by the junior associate of their learned counsel. The matter was fixed today for arguments on application U/S 265-K, Cr. PC. The accused side had argued on date before the last date of hearing, while the complainant on said both dates, filed adjournment applications. Today again, instead of arguing, which he is fully capable of doing as an advocate, he sought yet another adjournment, expressing his intention to seek a transfer of the case. It has been observed that proceedings on several prior dates have been disrupted by heated verbal exchanges between the parties. Furthermore, the record reflects that a related matter, Sessions Case No. 129 of 2012, involving the complainant party as accused, is pending before this Court, though its proceedings are currently stayed by the Hon'ble High Court of Sindh, Circuit Court, Hyderabad. The record also indicates a historical pattern: whenever previous Presiding Officers issued directions for expeditious progress in both matters, transfer applications were filed against them, preventing either case from reaching its logical conclusion. Nevertheless, the complainant is at liberty to file a transfer application. Accordingly, the case is adjourned to 29-08-2026 at 8:30 AM with direction that in the event such a transfer application is filed, the complainant shall produce its proof, and in case he fails to do so, the stage of instant matter shall be same (hearing of application U/S 265-K Cr. This is a Sessions case instituted upon a direct complaint. The complainant, who is himself an advocate, is present along with his witnesses; however, his learned counsel is absent. All accused persons are present on bail, accompanied by the junior associate of their learned counsel. The matter was fixed today for arguments on an application under Section 265-K, Cr. PC. On the previous date of hearing, the accused side concluded its arguments on the said application, while the complainant requested an adjournment to file written arguments on a date of his own choosing, being today (05-08-2026). Instead of filing the same or arguing orally, which he is fully capable of doing as an advocate, he sought yet another adjournment on the ground of his counsel's absence. The Court questioned him regarding these repeated requests for adjournments during the Section 265-K proceedings, as well as his recurring failure on previous dates to enter the witness box and produce his witnesses. In response, he filed an adjournment application alleging that the Court is inclined towards the accused and expressing his intention to seek a transfer of the case. He further objected that two of the accused, who are advocates by profession, should not occupy the advocates' row reserved for addressing the Court but must remain with the other accused, and he sought formal action against them on this account. It has been observed that proceedings on several prior dates have been disrupted by heated verbal exchanges between the parties. Today, one of the accused referred to the complainant as a "criminal," to which the complainant responded in a similarly harsh manner, subsequently seeking action against the accused for the remark. Furthermore, the record reflects that a related matter, Sessions Case No. 129 of 2012, involving the complainant party as accused, is pending before this Court, though its proceedings are currently stayed by the Hon'ble High Court of Sindh, Circuit Court, Hyderabad. The Sessions Case No.596/2022 arising from Direct Complaint U/S 200 Cr. PC is called. The all accused are present on bail along with Junior Associate Mr. Wajid Ali of their learned counsel Mr. Ayaz Ali Gopang. On the other hand, complainant Mr. Lutufullah Arain, a practicing advocate, is present along with witnesses Waqas and Mushtaque. Amongst the all 9 accused present in Court, one Mr. Mehboob Ali Jokhio, is a practicing advocate, request that he may be heard in person, as his learned counsel is unable to appeared today for personal reasons and that he, being a practicing advocate also, is prepared to argue. This case was instituted upon a direct complaint. The case is called. The complainant is present. All accused are present on bail along with their learned counsel, Mr. Ayaz Ali Gopang. The matter is fixed for recording the evidence of the complainant and his witnesses. Alongside the complainant, one witness, Mr. Waqas Arain, is present. The remaining witnesses and learned counsel are absent. The complainant has filed an application seeking adjournment on the ground that proceedings in the counter case of the accused party have been halted by an order of the Honourable High Court of Sindh, Circuit Court, Hyderabad. He therefore requests that proceedings in the present case also be adjourned. There is no order staying proceedings in the present case; the stay order pertains to Counter Sessions Case No.129/2012. However, in the larger interest of justice, the complainant is directed to proceed with the case on the next date of hearing. In the event of non-compliance, the Court shall hear arguments on whether powers under Section 265-K Cr. PC. should be exercised, as the complainant has failed to lead evidence since 18-10-2022, when the charge was framed. The complainant has also filed another application seeking legal action against accused Mehboob Jokhio and Aijaz Jokhio, alleging that despite repeated directions, they do not stand in the row of accused but instead occupy the place reserved for advocates. On the previous date of hearing, the complainant had sought action against accused Mehboob Jokhio for addressing him disrespectfully by calling him ???Lutu??? instead of his full name, Lutufullah Arain. Both accused, Mehboob Jokhio and Aijaz Jokhio, are practicing advocates and complainant party in the counter case. However, in the present matter, their status is that of accused. They are therefore strictly directed to stand in the row of accused during proceedings. It has been observed that the Court has exercised judicial restraint and tolerated the inappropriate conduct of both parties???Mehboob Jokhio (complainant in the counter case) and Lutufullah Arain (informant in the present case)???on multiple occasions, expecting them as advocates/officers of the Court to uphold decorum. Unfortunately, they have failed to do so. For instance, on the last date of hearing, Lutufullah Arain made an inappropriate remark about the health of Mehboob Jokhio???s father, to which Mehboob Jokhio responded with a similar remark about Lutufullah Arain. Both parties are hereby advised, in their own interest, to refrain from such behavior in Court. Any repetition will invite strict legal action. The case is adjourned to 15-04-2026 at 08:30 AM, when the counter case is also scheduled for hearing. The complainant is directed to appear along with his witnesses and learned counsel. Co-accused Abdul Sattar, who is son of absent accused Abdul Qadir, has filed application for condoning the absence of Abdul Qadir on ground of his illness.
