Accused Ali Akbar is convicted u/s 265-H (2) Cr.P.C and sentences him u/s 302 (b) R/w section 34 PPC to suffer life imprisonment as Tazir with direction to pay Rs. 200,000/ (Two Lacs) as compensation to the legal heirs of deceased Ali Nawaz as required U/S 544-A. In case of failure to pay of compensation, the defaulting convict shall further suffer S.I for six months. Accused Ali Akbar is also convicted and sentences him u/s 302 (b) R/w section 34 PPC to suffer life imprisonment as Tazir with direction to pay Rs. 200,000/ (Two Lacs) as compensation to the legal heirs of deceased Ashique Ali as required U/S 544-A. In case of failure to pay of compensation, the defaulting convict shall further suffer S.I for six months. Accused is further convicted u/s 337-A (i) PPC and sentences him to pay daman Rs. 20,000/ (Twenty Thousand) to injured/complainant Zaffar Ali and suffer R.I for two years as Tazir. Accused is further convicted u/s 337-L (2) PPC and sentences him to pay daman Rs. 10,000/ (Ten Thousand) to injured/complainant Zaffar Ali and suffer R.I for two years as Tazir. Accused is further convicted u/s 324 PPC RW/s 34 PPC and sentences him to suffer R.I for seven years as Tazir and to pay fine Rs. 25,000/ (Twenty Five Thousand Rupees). In case of failure to pay fine, he shall suffer S.I for one year more. If the convict fails to pay the daman he shall be dealt with as provided u/s 337-Y(2) PPC. The amount of Daman if paid by the convict shall be distributed as provided u/s 337-Z PPC. All the sentences awarded to convict/accused as Tazir shall run concurrently. Benefit of section 382-B PPC is extended to the convict and their earlier detention period in this case shall be counted in a sentence awarded to them. Accused Ali Akbar is produced in custody hence he is remanded to jail with conviction warrant/slip to serve out his sentences.
