For what has been discussed above I am of the considered opinion that accused were implicated by the complainant in FIR and so also by witnesses in their 161 Cr.P.C statements. Therefore the request of SHO PS Mirpur Mathelo for disposing of the case under ???C??? class is declined, the cognizance is taken u/s 190(1) b Cr.P.C. against all accused persons. Keeping in view the guidelines taken form the para No. 10 of judgment passed by Honorable High Court of Sindh in case reported as 2020 P.Cr.LJ 835, SHO PS MPM is directed to submit the Challan on 19.10.2026 on prescribed proforma without fail. Let the copy of order be sent to concerned SHO for information and compliance. |
