Matter called. Advocate for Plaintiff is present. Advocate for Defendant No.3 is present. None is present from Defendant No.1, 2, 4, 5 & 6 side. The matter is fixed for filing of amended written statements by Defendants side and hearing on application under Order VII rule 11 CPC. The record shows that on 10.02.2025, application under Order I rule 10 CPC filed by Intervener/Defendant No.5 was allowed and the Plaintiff was directed to file amended plaint. On 06.03.2025, the application under Order I rule 10(2) CPC filed by Defendant No.1 and another application under Order I rule 10 CPC filed by Plaintiff for impleading KDA as party were also allowed and the name of Defendant No.1 was struck off from the array of Defendants while the Defendant/KDA impleaded as a party. On same day i.e. 06.03.2025 the Plaintiff filed such amended plaint, however, he did not removed the name of Defendant No.1 from the array of Defendants despite, he arrayed the Intervener Nadeem as Defendant No.5 and Director Land KDA as Defendant No.6. Thereafter, the Defendant No.5 Nadeem already filed his written statement on 12.05.2025 as available on record alongwith application under Order VII rule 11 CPC, to which the Plaintiff has already filed counter affidavit on application under Order VII rule 11 CPC on 09.07.2025, thereafter, the matter has been wrongly/mistakenly adjourned for hearing on application under Order VII rule 11 CPC as well as amended written statement despite, the written statement of newly added Defendant No.5 is already on record and no any process against newly added Defendant/KDA issued. In the said circumstances, the matter is adjourned to 10.12.2025 for proper stage i.e. hearing on application under Order VII rule 11 CPC and service upon Defendant No.6/KDA through Bailiff. |
