B.Ws were issued upon accused Fayyaz Ali and Mst: Azra , which is returned served. Thereafter, Accused Fayyaz Ali and Mst: Azra are present. Mr. Ahmed Ali Chandio advocate filed Vakalatnama on behalf of accused. Order passed on it. File. Today, the instant case is fixed for submission of sureties by the accused persons namely Fayaz Ali and Mst. Azra, who have brought one Barkat Ali Soomro son of Allah Ditto Soomro as their surety. He has submitted original surety papers/documents in shape of card of vehicle viz. Suzuki Cultus No.BDE-532 Chassis No.SF410PK509363, Engine No. PKF602496 Model 2015 through Mr. Ahmed Ali Chandio advocate. On close scrutiny of document, it was transpired that the document was not original card but it was photocopy and resembling to be original, thus, under such circumstances, the surety was verbally asked as to why he has submitted/used coloured photocopy of original card as genuine being surety documents in Court, thus, he has immediately offered his unconditional apology and his advocate also offered unconditional apology and after a while submitted original card being the document of above mentioned vehicle which was taken on record and the same was sent to concerned quarter for verification. In the meantime, an explanation/show cause notice be issued to surety as to why he had used photocopy of the document as genuine in Court by submitting surety. He shall submit his reply on 27-02-2026. Though he has reply before issuing of show cause notice but he after receiving show cause notice shall submit proper reply as to why the legal action warranted under the law should not be taken against him. To come up on 27-02-2026. Thereafter, Barkat stood surety for accused Fayyaz Ali and Mst: Azra and he has produced Original Vehicle Suzuki Cultus car documents. Order passed thereon. Provisionally surety accepted subject to verification. Issue letter to Inchrge Motor vehicle Civic Centre Karachi for calling of verification and mortgaged entry in the record of rights. Thereafter, in compliance of U/S 265-C CR.P.C case papers supplied to accused Fayyaz Ali and Mst: Azra on free of costs vide receipt at Ex.01. Case adjourned to 27.02.2026. For framing of charge. Accused present on bail they are directed to attend on next date of hearing on next date of hearing. |
