Perusal of case diary show that on second last date of hearing the associate/junior of the learned defense counsel appeared and had requested that the case be fixed on 21.11.2025 as his senior is scheduled to appear before this Court on that requested date however considering the case pertaining to old category and keeping in view that the same is required to be proceeded expeditiously as per directions of the Honourable High Court of Sindh and National Judicial Policy the request was declined and case was fixed on 19.11.2025 and the summons were issued to the remaining witnesses. However on last date of hearing the witnesses did not appear and the associate/junior again put the same request that the case be fixed on 21.11.2025. His requested was allowed on last date of hearing and the case was adjourned/fixed today i.e. 21.11.2025. Today when the case was called even that associate advocate called absent. The learned defense counsel is also absent as before the other associate/junior counsel of the learned defense counsel appeared and stated that his senior would not appear today and examination in chief of the present witness be recorded. Order passed on separate order sheet the examination in chief of WHC Sikandar Ali recorded at Ex......13 and the cross examination of the witness was reserved due to non-appearance of the learned defense counsel and the show cause notice issue to the accused due to continuous absence of his counsel the case be proceeded providing him another advocate as the matter pertains to the heinous offence entailing capital punishment or the opportunity given to engage another counsel.
