Matter called, Learned counsel for plaintiff Mr. Mukesh Kumar is present, Learned DDA Mr. Mushtaque Ahmed Abro is present on behalf of defendants Ns. 5, Mr. Ahmed Ali Ghumro advocate is present and filed Vakalatnama on behalf of defendants No.1 to 4. Learned counsel for the plaintiff has requested for appointment of a Commissioner for inspection of the suit plot in order to verify/ascertain the construction of the boundary wall made by the plaintiff. Learned counsel for plaintiff pressed the application for grant of ad-interim injunction, Learned counsel for defendants No.1 to 4 oposed the request for grant of ad-interim injunction, Learned counsel for plaintiff has requested for appointment of a commissioner for inspection of the suit plot, Learned counsel for defendants No.1 to 4 has extended no objection to the appointment of a Commissioner; the request is allowed. Accordingly, the Mukhtiarkar, Thano Bola Khan, is directed to inspect the suit property, particularly with regard to the construction existing thereon and the status of possession of Plot No.D/101-F, measuring 05 acres, situated at SITE, Nooriabad. He shall submit his report before this Court on or before the next date of hearing. The concerned parties and officials may remain present at the time of inspection and extend necessary assistance to the Mukhtiarkar for carrying out the inspection. Meanwhile, learned counsel for the plaintiff is directed to address arguments on the maintainability of the present suit on the next date of hearing. Office is directed to issue letter regarding site inspection to concerned Mukhtiarkar as ordered.
