Order on it. Mr. Mushtaque Ali Chandio, the counsel for applicant, vehemently pressed this Court to adopt coercive measures and take attorney of JD into immediate custody for failing to clear entire arrears/amount. This Court repeatedly advised the counsel to file a formal, written application to this effect, as ordering detention entails a mandatory legal procedure that must be strictly adhered to. However, learned counsel insisted the Court to act suo motu, aggressively stating "I know procedure will give further time to attorney." Upon refusal to bypass due process and act whimsically, Mr. Mushtaque Ali Chandio advocate became visibly hostile, changed his demeanor, and began shouting harshly inside the courtroom, disrupting the solemnity of proceedings. The counsel was repeatedly cautioned and advised by the court to mend his tone, maintain professional decorum, and address the Court with requisite respect and file application if so needed, on which he left the court room. This type of attitude invites application of section 16 of West Pakistan Family Court Act, 1964/the contempt proceedings but looking to the minors interest and in the interest of justice such like proceedings are not initiated. Applicant files two applications in person in Sindh language, on for receiving maintenance amount and another for recovery of arrears. Order on it. Office to disburse amount Rs.40,000/- to applicant under a receipt, nonetheless for other measures applicant to file proper application under the procedure known to law. Matter adjourned to 16.06.2026. |
