Order Announced in open court.application under Sections 3 & 4 of the Contempt of Court Ordinance, 2003 read with Article 204 of the Constitution is hereby disposed of with observation that no sufficient material presently exists for proceeding further against Official Defendant No.04 for civil contempt. However, all defendants, their agents, subordinates, representatives, police officials, revenue authorities or any person acting on their behalf are strictly directed to maintain status quo with regard to nature, possession and construction over the suit property and shall not undertake any fresh construction, demolition, dispossession or interference of any nature whatsoever until final decision of the suit or unless otherwise directed by this Court. The application under Section 94 read with Section 151 CPC is allowed to the extent that the learned Nazir of this Court is appointed as Reciever/Commissioner with directives to ensure implementation of the injunctive order dated 25.07.2024 and, if necessary, may appoint suitable private guards/watchmen at the cost and responsibility of the Plaintiff for preservation of the suit property, subject to furnishing requisite expenses within three days. The SHO concerned is further directed to extend full lawful assistance to the Nazir for implementation of this order and maintenance of peace at the site strictly in accordance with law. Any future violation of the injunctive order or interference with the suit property shall expose the delinquent party to strict legal consequences including fresh contempt proceedings. Matter adjourned to 08.07.2026 for further proceeding. Office is directed to comply the order Dated:-19-05-2026. |
