Ghulam Ali all sons of Nooruddin 04. Muhammad Ali son of Abdul Sattar all by caste Marfani Chandia have been convicted u/s 265-H(ii) Cr.P.C collectively and sentenced as under; 01. For offence U/S: 302(b) PPC to death as Tazir (each convict) for commission of murder of Shahban son of Aalam Khan by caste Marfani Chandio 02. For offence U/S: 302(b) PPC to death as Tazir (each convict) for commission of murder of Mujeeb-u-Rehman son of Pehlwan Marfani Chandio 03. For offence U/S: 302(b) PPC to death as Tazir (each convict) for commission of murder of Noor Ahmed son of Naseer Ahmed by caste Marfani Chandio, therefore they are ordered to be hanged by their neck till they are dead subject to confirmation by Honourable High Court of Sindh Circuit Court Larkana and 500,000/- (five lac rupees) each total 20,00,000 (twenty lac rupees only) as compensation amount to the legal heirs of each deceased in terms of section 544-A Cr.P.C (each accused). In case of non-payment of compensation amount they shall suffer S.I for six months more. As such they are sentenced to death on three accounts. 04. For offence u/s 324 PPC and sentenced to five years (R.I) as well as Rs: 30,000 (thirty thousand rupees only) each convict as fine amount. In case of non-payment of fine amount they shall suffer S.I for two years. 05. For offence U/S; 337-D PPC Arash of Rs: 743400.66 (each convict). 06. For offence U/S; 337- A (i) PPC Daman of Rs: 30,000 (thirty thousand) (each convict). In case of non-payment fine amount each above named accused shall suffer S.I for six months more. 07.For offence u/s 337-H(ii) PPC fine amount of Rs: 20,000 (twenty thousand rupees only) total amount RS: 60,000 (sixty thousand rupees only) each accused. 08.For offence u/s 148 PPC Daman amount of Rs: 30,000 (thirty thousand rupees) each convict. All sentences so awarded other than death will run concurrently. However the benefit of section 382-B Cr.P.C stands extended to the above named accused/convicts, for the period, which they have already remained in jail as UTP. The above named accused sent back to custody with conviction warrant and slips so also with directions to jail authorities to keep them in safe custody to serve out the sentence as per law/rules. The record and proceedings of this case has been received by way of transfer from the court of learned II-Additional Sessions Judge, Kamber-Shahdadkot for disposal in accordance with law.
