Matter called, Accused Farooque Ahmad is present on bail. Accused Ghulam Ali called absent. Accused Farooque Ahmad (son of accused Ghulam Ali) submitted an application along with PS copy of notice u/s 514 Cr.P.C stating therein that accused Ghulam Ali has went to Honourable High court of Sindh,Circuit Court Larkana for submission of reply of notice u/s 514 Cr.P.C issued upon him. Proclamation warrant u/s 87 Cr.P.C returned unserved by HC Shah Murad, his statement recorded at Ex.No 02, he produced warrant u/s 87, Cr.P.C memo of mashirs, memo of publication, entry and letter of SHO R&R as Ex.No 02/A to Ex.No 02/E. Report of proclamation warrant u/s 88 Cr.P.C also received from concerned Muhkhtiarkar, same kept on record at Ex No 03. Matter put off to 22.12.2025, for receipt. The offence u/s 324 PPC is exclusively triable by the Court of Honourable District and Sessions Judge, let the R&Ps be sent up to the Court of Honourable District and Sessions Judge Kashmore at Kandhkot as legal formalities has been completed against absconding accused. Present accused Farooque is directed to attend on next date of hearing before the Court of Honourable District and Sessions Judge, Kashmore at Kandhkot so also informed the date of case to accused Ghulam Ali.

Matter called,Accused Farooque Ahmed is present on bail.Learend ADPP for state is present. Learned counsels for both parties are present.Today matter is fixed hearing on final challan U/section 173-A Cr.Pc. Heard arguments from both sides. Order prepared and announced in open court. Accordingly I am disagree with the opinion of IO, as a result; I am convinced with view of learned DPP. The evidence collected during investigation is sufficient to join the accused person placed in column No.2 to face his trial before Court. Consequently, I hereby take cognizance against all accused including let off accused, namely Ghulam Ali 2- Pervez both sons of Shahmoor 3- Altaf s/o Ghulam Ali, 4- Farooq son of Pervez, and 5- Hussain alias Moula Bux all by caste Bhaya under section 324, 337-F(i),-(v), 337-H/2, 148, 149, PPC. Since alleged offence under section 324 PPC is exclusively triable by the Honorable Court of Sessions, let the R &Ps be submitted before the Honorable District & Sessions Judge Kashmore @ Kandhkot after completing the legal formalities. Office is directed to issue NBW of absconder accused, while BWs in sum of Rs: 50000/-(fifty thousand) against co-accused Ghulam Ali son of Shah More Bhayo, who was placed in column No: 2. Matter put off to 11.12.2025 for service. Present accused is directed to attend on the date of hearing. |
