Case called. Accused Fida Hussain Mallah produced from Sub Jail Sehwan. ADPP present. Case papers supplied to him, such receipt obtained from him at Ex No.01. Accused submitted application that he do not want time and today charge may be framed. Order passed on it. Charge framed against the accused at Ex No.02, in which accused pleaded guilty at Ex No.02/A. Accused submitted application for pleaded guilty at Ex No.03. Order passed on it. Issue show cause U/S 243 Cr.P.C to accused. Show Cause U/S 243 Cr.P.C given to the accused at Ex No.04, on which accused submitted reply of notice U/S 243 Cr.P.C at Ex No.05. Heard learned ADPP for the state and perused the relevant record. Order prepared and announced in Open Court. Accused Fida Hussain Mallah convicted U/S 243 Cr.P.C and awarded sentence to suffer simple imprisonment for (03) months and to pay fine of Rs.300/-, in case of default of payment of fine accused shall suffer S.I for (11) days for offence punishable U/A 3/4 PEHO. Benefit of section 382-B Cr.P.C be given to the accused. Accused Fida Hussain remanded back into custody with acquittal warrant and conviction to serve the sentence as awarded to him. |
