Family suit called. Plaintiff and her counsel Adv Rameez Chajjro are present. Defendant and his learned counsel Mr. Rafique Kalhoro are also present. The matter was fixed for cross-examination of the plaintiff and her witnesses. Learned counsel for the plaintiff agreed that the cross-examination would be conducted at 10:45 a.m. At the second call at 10:45 a.m., the plaintiff, her counsel's munshi, junior counsel for the plaintiff, the defendant, and learned counsel for the defendant appeared. The cross-examination of the plaintiff was recorded in open court at Ex. P-1. After the cross-examination, the plaintiff left the court without signing the printed cross-examination. Upon calling the case again, no one appeared from the plaintiff's side. At the next call, the plaintiff appeared with her learned counsel and stated in open court that her cross-examination had not been recorded. Learned counsel of the plaintiff verbally stated that cross-examination of the plaintiff should be recorded again since it was recorded when he was at another court. The court, after due consideration of the request, found no justifiable cause to reopen the cross-examination and, in exercise of its discretion, respectfully declined the prayer for re-examination. The learned counsel for the plaintiff further stated that he is ready for cross-examination of the witnesses. Thereafter, the cross-examination of the witnesses Aamir Ali was recorded at Ex. PW/1. Thereafter, learned counsel for the plaintiff submitted an affidavit in evidence of the second witness, Bakhtawar. Order on it. Copy was supplied to the other side. The cross-examination of Bakhtawar was then recorded in open court at Ex. PW/2. After the cross-examination, learned counsel for the plaintiff stated that he would file the side-closure statement shortly; however, he failed to do so.
