B.Ws issued against official P.Ws, which returned back with endorsement of SHO, official P.Ws are called absent. Property produced by concerned P.S. Learned ADPP for the state has filed statement for keeping the case in abeyance at ex-15. Heard arguments. Order passed on separate sheet and announced in open court, at Ex-16, On account of non-attendance of complainant and private witnesses, accused cannot be subjected to agony of dates, particularly when complainant and remaining private witnesses are not willing to proceed with the case. Hence, keeping forth the above position, I hereby order that this Sessions case be kept in abeyance against accused namely; Mst. Sasui and Mir Dad @ Mir Muhammad s/o Dilsher @ Muhammad Umer. Mst. Sasui is present on bail. Surety already submitted by her shall be bound for the period of three years. Mst. Sasui is also directed to furnish PR bond in the like amount for attending the Court for trial, if and when called. The accused Mir Dad @ Mir Muhammad is present in custody and produced by concerned jail authorities through video link and ordered to be release him subject to furnishing solvent surety in the sum of rs.2,00,000/- Two lacs & PR bond in the like amount. The surety of accused shall be intact for the period of three years. Prosecution side is at liberty to apply for re-opening of the case after availability of complainant and private witnesses. While passing this order reliance was respectfully placed on reported case of SIP Saeed Ahmed Shaikh and others v/s Muhammad Bakhsh and another (SBLR 2015 Sindh 948). P.R bond obtained from accused Mst. Sasui, which is kept on record. Put off to 03-04-2025 for compliance. Issue process to complainant and private P.Ws.
