Learned ADPP for the state is also present. In this case, the Honourable High Court of Sindh, Circuit Court Mirpurkhas had been pleased to direct this Court for expedite the trial and conclude the same within 60 days. Today the instant case is fixed for evidence, the complainant attend the Court and brought a new advocate Madam Fareeda Naz, she has filed power without application U/S 493 Cr. PC and so also filed adjournment application. She has also filed another application stating therein that the accused persons namely Ali Raza alias Jaro son of Ali Murad Khaskheli and accused Arbab Ali son of Ali Murad Khaskheli are absconders in case/crime No.242 of 2025 U/S 5-8(i) GMA of Police Station Tando Adam City and crime No.52 of 2026 U/S 3/4 PEHO of PS Tando Adam City and requested for arresting them. So far this application is concerned; learned state counsel was asked to have got the verified from the concerned Court. He after having been verified the actual fact from the concerned Court stated that accused Riaz Ali alias Jaro involved in case/crime No.242 of 2025 has already been acquitted in his absentia while accused Arbab Ali in case/crime No.52 of 2026 U/S 3/4 PEHO is absconder; however counsel for accused stated that accused got bail but he has no bail order. The lady advocate for the complainant asked to proceed with the case because directions of the Honourable High Court of Sindh has been issued but she has shown her reluctance to proceed the case and insisted to have adjourned the case and for arresting the accused persons and further stated that police officer of Police Station Tando Adam also standing outside the Court having warrant. Be that as it may, the case is adjourned and the police of Tando Adam if possessed warrant of arrest, then he is at liberty to act in accordance with law. As soon as, the case is adjourned and accused left the Court, thus, police officer of Police Station Tando Adam arrested the accused. Anyhow, the case is adjourned to 28-04-2026 for evidence. |
