Criminal appeal of applicant/accused Wajihullah called. Mr: Khalid Mustafa Shoro advocate for accused is present. Learned DDPP for the state is present. Application U/S 426 Cr.P.C is on record. On previous date of hearing complainant submitted application for grant of adjournment. The same was vehemently opposed by Mr. Khalid Mustafa Shoro, learned counsel for the appellant. He had contended that the complainant of the case is trying to prolong the proceedings and application u/s 426 Cr.PC which is pending. On last date of hearing application for grant of adjournment was allowed but today complainant has submitted application and he do not want to proceed with the appeal. He has submitted application of no confidence. He may file transfer application. Another execution application filed by the son of the complainant is pending in which the Honourable High Court of Sindh has been pleased to suspend operation of the judgment of the summary suit on the same cheques which are subject matters of this criminal appeal and FIR. Such order of Honourable High Court of Sindh passed in the First Appeal No.S-43 of 2026 has been received to this court. However, in the interest of justice let the reference be submitted to the Honourable District and Sessions Judge Jamshoro for transfer of appeal and execution application to any other court for disposal in accordance with law. Such reference has been submitted to the Honourable District & Sessions Judge, Jamshoro.
