The civil appeal is called. The appellant and his counsel are present. The respondent is absent, and learned counsel for the respondent is also not present. However, the Junior Partner of the respondent???s counsel is present.An application under Order 6, Rule 17 of the Code of Civil Procedure (CPC) was filed by the appellant on 13th May 2025. A counter-objection to the said application was filed by the respondent on 21st June 2025. Due to an oversight, the instant application, the counter-objection was incorrectly placed in Civil Appeal No. 6/2025 (Abdul Shakoor vs. Amjid Shahdue) instead of the present appeal.In view of the above, the application and the counter-objection have now been placed before the Court in the current appeal for hearing. The Junior Partner of the learned counsel for the respondent has requested an adjournment. The request is granted.By consent of both parties, the appeal and the application under Order 6, Rule 17 CPC are hereby adjourned to 18. 10., 2025 for the hearing of the instant application and the main appeal. |
