After hearing the submissions of learned counsel for the decree holder and upon perusal of the record, it is evident that the decree passed by this Court has attained finality and the Judgment Debtors have failed to comply with the same despite sufficient opportunity. The executing Court is duty bound to ensure that the decree is effectively implemented. Since the application for authorization of the Nazir to execute the sale deed on behalf of the Judgment Debtors has already been allowed and the remaining property is available in their names as per the sale certificate issued by the Mukhtiarkar, no legal impediment appears in allowing the present request of the decree holder. In view of the above facts and circumstances, the prayer made by the decree holder in his statement is hereby allowed. The Nazir/C.O.C of this Court is directed to execute the registered sale deed in favour of the decree holder in respect of the remaining agricultural land measuring 09 acres and 11 ghuntas on behalf of the above-named Judgment Debtors in accordance with the terms of the decree. Necessary compliance report be submitted accordingly. Put up to------12-03-2026 for compliance of Nazir/COC.
