Accused namely Zahoor Ahmed s/o Atta Muhammad by caste Khoso has been convicted U/S 265-H(ii) Cr.P.C for an offence punishable U/S 302 (b) PPC R/W section 34 PPC and sentenced to suffer for life imprisonment as a TAZIR. Accused has also been directed to pay an amount of Rs:1,00,000/- (One lac rupees) as a compensation as provided by section 544-A Cr.P.C. If the aforesaid compensation amount is recovered from the accused, same shall be paid to the legal heirs of the deceased namely Shah Muhammad Khoso in equal shares. In case, in default, in payment of compensation amount, the accused shall suffer 06 months S.I more. It is also clarified that the sentence of imprisonment awarded to the accused, in default of payment of compensation amount of Rs:1,00,000/-(One lac rupees), shall run in excess/addition of the substantive sentences as provided by section 64 (3) PPC. However, the benefit of section 382-B Cr.P.C has also been extended to the accused from the date of his arrest. The accused is present on bail. His bail bond has been cancelled and his surety stood discharged. He has been taken into custody and he has been remanded to Central Prison/Correctional Facility Sukkur with conviction warrant and conviction slip in order to serve out the sentences awarded to him. Whereas the case against both the absconding accused persons namely Tufail Ahmed and Abdullah both by caste Khosa has been kept on dormant file till their arrest or they voluntarily surrender.
