Case called. Accused Muhammad Nawaz is produced in custody by Sup: C.P Hyderabad, while accused Asif and Shafqat are called absent and have already been declared as P.Os. DPP and DC are present. Judgment passed and announced in open court R & R??????????????????????????????????????????????????????????????????????????????.as Ex: 18. The prosecution has proved the case against the accused beyond the shadow of reasonable doubt for offence u/s 496-A PPC. Accused is facing trial from Jail and he is in custody since the day of his arrest i.e. 16.09.2014. Thus, accused has remained in custody for two (02) years and 10 days, which punishment is sufficient to the end of justice. I hereby convict the accused Muhammad Nawaz s/o Haji Rustam Khan and sentenced him u/s 265-H (ii) Cr.P.C to undergo R.I for two years and 10 days. His period of detention since the day of his arrest i.e. 16.09.2014 as under trial prisoner be treated as already under gone as benefit of section 382-B Cr.P.C. Accused produced in custody and is remanded along with conviction warrant to serve out the sentence awarded to him under this judgment. The case of proclaimed offenders, Asif and Shafaqat is kept on dormant file till their arrest or they voluntarily appeared before this court.
