Mr. Khadim Hussain Pathan Advocate for accused is present. Case property produced by concerned P.S. B.W issued against remaining official witnesses which returned back with endorsement of SIP Jan Muhammad of P.S Rustam. No P.W is present. All accused have filed joint application of keeping the case in abeyance at Ex-14. Order on it. Notice to ADPP. Learned ADPP noted the same. Arguments heard. Order passed on separate sheet and announced in open court, at Ex-15. On account of non-attendance of complainant and remaining PWs, accused cannot be subjected to agony of dates, particularly when complainant and PWs are not willing to proceed with the case. Hence, keeping forth the above position, I hereby order that this Sessions case be kept in abeyance against accused Lashkari s/o Hamal, Muhammad Saleh @ Salar s/o Hamal, Hazoor Bux s/o Sobdar, Muhammad Umar s/o Abdul Hakeem and Abdul Karim @ Nano s/o Razi. Accused are present on bail, surety already submitted by them shall be bound for the period of three years. Prosecution side is at liberty to apply for re-opening of the case after availability of complainant and remaining private witnesses. While passing this order reliance was respectfully placed on reported case of SIP Saeed Ahmed Shaikh and others v/s Muhammad Bakhsh and another (SBLR 2015 Sindh 948). Case is put off to:- 20.09.2025.
