Accused Nisar Ahmed son of son of Mohammad Ibrahim and Ali Akber son of Ghulam Hussain Shaikh have been convicted u/s 265 H(ii) Cr.P.C for the offence Punishable under section 302 (b) PPC and sentenced them for life imprisonment (R.I). Accused are also directed to pay Rs:3,00,000/- (Three lac Rupees) each as compensation, in term of section 544-A Cr.P.C. If the aforesaid compensation amount is recovered from the accused, same will be paid to the legal heirs of the deceased Ameer Ali Brohi in equal shares. In case, in default in payment of compensation amount, both accused, shall suffer six months S.I. more. Accused are also convicted for offence punishable u/s 324 PPC for a period of five years each, under section 337-D with (Arsh 1/3 of Diyat) to be tune Rs:6,85,312/- each. However, the current valuation of Diyat is Rs:20,55,936/-. All the sentences of imprisonment awarded to both accused shall run concurrently. While accused Riaz Shaikh, Akhtiar, Akber and Mumtaz Ali are acquitted u/s 265 H(i) Cr.P.C, they are present on bail, their bail bond stand cancelled and sureties discharged. Accused Nisar Ahmed Shaikh and Mohammad Ibrahim are taken into custody and remanded to central prison Larkana, with directions to supt to keep the into safe jail custody in order to serve out the sentences awarded to them by this court. The Judgment is placed on record at Ex:25. A compared copy of free of costs has been supplied to the accused and such receipt obtained from them at Ex:26. |
