In view of attending circumstances, the plea of accused persons admitting the guilt seems voluntarily and without any pressure. On the other hand the accused persons are First Offenders and seems repented on their act. Therefore considering all the circumstances, the accused persons namely Sanwan & Mashooque Ali are hereby convicted under Section 245 (ii) Cr.P.C for the offence punishable under section 8 (i) of SPPMSS and Use of Gutka Manpuri Act, 2019 and sentenced him S.I for one year. The custody of accused is handed over to Probation Officer with directions to appear before the probation officer twice in a month and the Probation officer shall keep watch on him and submit a monthly report to this Court. After the successful completion of the probation period, the surety shall be discharged and the bail bond shall also be cancelled. Let the copy of this judgment be supplied to the accused free of cost and acknowledge receipt thereof in compliance of Section 371(1) Cr.P.C. Let the R & PS be consigned to record room after expiry of appeal period. |
