Today order passed, as per Order, "By dint of this Order I would like to dispose of two applications as filed from the side of the plaintiff i.e. under Order 1 rule 10 CPC and under Order VI rule 17 read with section 151 CPC. Upon notice, the learned counsel for the proposed defendants appeared and raised no objection in respect of the first application under Order 1 rule 10 CPC however invited the attention of this Court that the application under Order VI rule 17 CPC is waged and made in replication of the application under Order 1 rule 10 CPC. He pointed out that no single amendment has been sought and therefore he is unable to give even any counter affidavit as the subject application on the face of it is liable to be dismissed. On the other hand, learned counsel for the plaintiff conceded this fact and failed to point out any substantial amendment for the consideration of his application under Order VI rule 17 CPC.
